At Info Tech, Inc., (“Info Tech”) we value the trust you place in us when you visit our website (“Site”) and we take our responsibility seriously. This website and all of the tools and services on our website are owned and operated by Info Tech. By visiting our website you accept the terms of use. If you do not agree to these terms of use, do not access or use the Site. We reserve the right to make changes to our terms of use. Please check back from time to time to ensure you are aware of any changes. Your continued use of our site will signify your acceptance of these changes.

IN NO EVENT WILL INFO TECH BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SITE INCLUDING WITHOUT LIMITATION ANY ONLINE SERVICES OR DOCUMENTS AVAILABLE VIA THE SITE.

Documents:

  • Permission to use documents, such as help topics, white papers, datasheets and FAQs (“Documents”) that are made available through the Site is granted, provided that (1) the copyright notice which exists on the document appears in all copies, (2) use of the Documents is for informational and non-commercial or personal use only and will not be copied or posted on any network computer or broadcast on any media, and (3) no modifications of the Documents are made. Use for any other purpose, unless permission is otherwise granted by the Document copyright owner, is expressly prohibited by law, and may result in civil or criminal penalties.

  1. Acceptable Use Policy:

The goal of Info Tech is to provide high quality services to the customers. Info Tech reserves the right, in Info Tech’s sole and exclusive discretion, to remove any content for any reason, including but not limited to, reasons listed in this Acceptable Use Policy. The Acceptable Use Policy below defines the actions relating to the content provided through the Sites which Info Tech considers to be inappropriate and thus prohibited. The examples named in this list are in addition to the types of content identified in any other applicable agreement, are non-exclusive, and are provided solely for your guidance. If you are unsure whether any contemplated use or action is permitted, please send an email in advance to webmaster@infotechfl.com and Info Tech will assist you.

Actions which Info Tech considers inappropriate include, but are not limited to, the following:

  • Using the Site to post any content of the nature set forth in 47 U.S.C. Section 230(c)(2)(A) (i.e., material that is obscene, lewd, lascivious, filthy, excessively violent, harassing or otherwise objectionable);
  • Using the Site to post any content that advocates, promotes or otherwise encourages violence against any governments, organizations, groups or individuals or which provides instruction, information or assistance in causing or carrying out such violence;
  • Using the Site to post any content that holds Info Tech (including its affiliates), employees or shareholders or any other person or entity up to public scorn or ridicule;
  • Using the Site to post any content that violates any copyrights, patents, trademarks, service marks, trade names, trade secrets or other intellectual property rights of others;
  • Failing to obtain all required permissions when using the Site to receive, upload, download, display, distribute, or execute programs or perform other works protected by intellectual property laws including copyright and patent laws;
  • Deleting or altering author attributes or copyright notices, unless expressly permitted in writing by the author or owner;
  • Using the Site in a tortious manner, including the posting of libelous, defamatory, scandalous, threatening, harassing or private information without the permission of the person(s) involved, or posting content that is likely to cause emotional distress;
  • Introducing viruses, worms, harmful code and/or Trojan horses on the Internet;
  • Misrepresenting your identity to access the Site, or misrepresenting your identity in any way while using the Site or with the aid of the Site;
  • Using the Site in any way to transmit or distribute any unsolicited bulk or unsolicited commercial email (i.e., spam);
  • Using any tools, programs, robotic algorithms or products to automatically download or “spider” the Site;
  • Otherwise using the Site in violation of any applicable laws;
  • Using the Site to resell, remarket, repackage or redistribute any portion of the Services or offer these Services to others.

Info Tech may and will terminate your access credentials (i.e., any user IDs, user names, passwords, etc.) to the Site immediately if, in its sole discretion, Info Tech believes that your conduct fails to conform to these TOU or any other applicable agreement, terms, or conditions. Without limiting the foregoing, if you use or attempt to use the Site for any purposes other than the purposes intended or contemplated as acceptable by Info Tech (including without limitation by tampering, hacking, modifying or otherwise corrupting the security or functionality of the Sites or Services), you may also be subject to civil and criminal liability.
  2. Privacy. We may collect and use personal information about you when you visit our websites, use our mobile and web applications, or call us on the phone.

By “personal information” we mean information that directly identifies you or your business, such as your name, address, or email address. We may collect the personal information and use it inside our websites and services. We may anonymize some of the data. For example, we receive certain standard information that your browser sends to every website you visit, such as your IP address, browser type and access times. This type of information is collected for purely internal purposes such as marketing analysis or demographic studies, and is used solely to improve Info Tech Site to better address our users’ needs.

Info Tech web pages may contain electronic images known as ‘web beacons’ that may be used to assist in delivering cookies on our sites and allow us to count users who have visited those pages. They are required by agreement to maintain the confidentiality of the information and are prohibited from using the information for any other purpose that delivering the service to Info Tech in accordance with Info Tech’s instructions and policies. However, our vendors may use aggregate data for fraud detection to help improve their services.

We may access or disclose your data in order to: (a) comply with the law when there is a clear, unambiguous legal duty to do so; (b) protect the property or rights of Info Tech or our customers, including the enforcement of our agreements or policies governing your use of the services; or (c) act in a good faith belief that such access or disclosure is necessary to protect the personal safety of Info Tech employees, customers or the public. We may also disclose personal information as part of a corporate transaction such as a merger or sale of assets — but only if this information is required by a clear legal duty and to the barest extent permitted to preserve the scope of the confidentiality of that Personal Information.

  1. Intellectual Property Rights

Info Tech and/or its suppliers retain all right, title and interest in and to the Site, including all copyrights, patents, trade secrets, trademarks and other intellectual property rights. Info Tech reserves all rights not expressly granted. These TOU do not grant or imply any rights to any Info Tech or supplier trademarks, trade names or logos. Info Tech only grants permission to a third party to use Info Tech-owned trademarks and/or logos according to the conditions and specifications listed on the Info Tech Trademark Notice and Policy.

  1. Notices and Procedure for Making Claims of Copyright Infringement

Pursuant to Title 17, United States Code, Section 512(c)(2), notifications of claimed copyright infringement should be sent to Info Tech’s designated agent. NOTIFICATIONS OF COPYRIGHT INFRINGEMENT MUST CONFORM TO THE FOLLOWING PROCEDURE – NONCONFORMING NOTICES WILL NOT RECEIVE A RESPONSE.   1. Revision or Termination of the Site

Unless otherwise obligated by a separate agreement, Info Tech reserves the right to modify or discontinue the Site temporarily or permanently, with or without notice and in its sole discretion. This includes the right to modify, discontinue or remove any content, postings, links, pages, services, or other materials at any time and for any reason. You agree that Info Tech shall not be liable to you for any modification, general suspension or discontinuance of any services. Info Tech may, in its sole discretion, refuse or restrict anyone from access to any or all of the Site at any time.

The content and functionality of this website is provided with the understanding that Info Tech is not engaged in rendering any professional advice or services to you.  This content and functionality on this website includes the ability for you to submit a question or to provide information, this is not be construed as an offer to engage in a professional relationship or an obligation for Info Tech to respond to you.

The Case Summaries contain a list of select cases in which Info Tech provided statistical analysis.  The Case Summaries do not contain a complete list of all cases and are not necessarily representative of results obtained by Info Tech.  Every case is different, and the facts and circumstances of your potential case may differ from our past cases and must be evaluated and handled on their own merits.

Info Tech maintains this website in Florida, U.S.A. and you agree that these terms of use and any legal action or proceeding relating to this site shall be governed by the laws of the State of Florida without reference to the principles of conflicts of laws thereof.
